1. Use of the Services

PlantGrail provides AI-powered plant health diagnosis, species identification, garden tracking, and care planning tools. The Services are intended for personal, non-commercial use.

You agree to:

• Use the Services only for their intended purpose (plant care and identification)
• Not attempt to reverse-engineer, decompile, or modify the app or its underlying technology
• Not use the Services to transmit harmful, offensive, or illegal content
• Not use automated systems (bots, scrapers) to access the Services
• Comply with all applicable laws and regulations in your jurisdiction

2. Accounts and Access

PlantGrail does not require a conventional username and password account. The app uses an app-specific pseudonymous device identifier to associate your plant data with your installation. Any profile name, email address, or avatar you choose to add is optional.

You are responsible for maintaining the security of your device. If you delete the app or reset your device, your local data and device identifier may be lost. We recommend contacting us at [email protected] if you need to transfer your data.

3. Free and Premium Tiers

3.1 Free Tier

The free tier includes:

• 3 lifetime AI scans (any mode)
• Up to 2 plants in your garden
• Access to basic plant care information and the PlantGrail knowledge library

Free scans are non-renewable. Once used, additional scans require a Premium subscription.

3.2 Premium Subscription

Premium unlocks unlimited AI scans, unlimited plants in your garden, the care calendar with push reminders, and all gamification features. Two subscription options are available:

• Monthly Premium: $4.99 USD per month (7-day free trial)
• Annual Premium: $29.99 USD per year (7-day free trial, includes the "7 Killers" mini-course)

Prices may vary by territory and currency. The price shown in the App Store at the time of purchase is the price you will be charged.

4. Subscriptions and Billing

All subscriptions are processed and billed by Apple (via the App Store) or Google (via the Play Store). PlantGrail does not directly handle payment information.

• Payment is charged to your Apple ID or Google account at the confirmation of purchase
• The free trial period (if offered) begins at the time of purchase. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• The renewal charge is applied within 24 hours prior to the end of the current period at the same price
• You can manage or cancel your subscription at any time through your device:
  • iOS: Settings → Apple ID → Subscriptions
  • Android: Google Play Store → Subscriptions
• Cancellation takes effect at the end of the current billing period — you retain access until then
• No refunds are provided for partial billing periods, except as required by applicable law or platform policy

5. AI Diagnosis Disclaimer

PlantGrail provides AI-generated plant health assessments for informational and educational purposes only. Our diagnoses are generated by AI vision models accessed through OpenRouter and are not a substitute for professional horticultural, agricultural, or botanical advice.

If you suspect a serious plant disease or pest infestation, we recommend consulting a qualified horticulturist or your local extension service in addition to using our tools.

6. Intellectual Property

All content within the Services — including but not limited to text, graphics, logos, icons, images, the Doc Sprout character, UI design, and software code — is the property of PlantGrail or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, reproduce, or redistribute any content from the Services without our prior written consent
• Use the PlantGrail name, logo, or Doc Sprout character for any purpose without permission
• Remove or alter any copyright or proprietary notices

6.1 Your Content

You retain ownership of any images you submit for scanning. By using the Services, you grant PlantGrail a limited, non-exclusive licence to process your images solely for the purpose of providing AI diagnosis and, when you choose to save them, garden and journal features. Retention is described in our Privacy Policy.

7. User Conduct

You agree not to use the Services to:

• Submit images that are not of plants (e.g., offensive, violent, or illegal content)
• Attempt to overload, disrupt, or interfere with the operation of the Services
• Exploit vulnerabilities in the app or API for unauthorised access
• Resell, redistribute, or commercially exploit any part of the Services

We reserve the right to suspend or terminate access to the Services for any user who violates these Terms.

8. Availability and Updates

We strive to keep the Services available at all times, but we do not guarantee uninterrupted or error-free operation. The Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We may update, modify, or discontinue features of the Services at any time. We will make reasonable efforts to notify users of significant changes, but we are not obligated to maintain any specific feature or functionality.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement
• PlantGrail shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services
• Our total aggregate liability for any claim related to the Services shall not exceed the amount you paid to us in the 12 months preceding the claim, or $50 USD, whichever is greater

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by applicable law.

10. Indemnification

You agree to indemnify and hold harmless PlantGrail, its officers, employees, and partners from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising from:

• Your use of the Services in violation of these Terms
• Your violation of any applicable law or regulation
• Any content you submit through the Services

11. Third-Party Services

The Services integrate with third-party providers, including:

• OpenRouter and selected AI model providers — AI image analysis
• RevenueCat — Subscription management
• Apple / Google — Payment processing and app distribution

Your use of these third-party services is subject to their respective terms and privacy policies. PlantGrail is not responsible for the practices or availability of third-party services.

12. Termination

You may stop using the Services at any time by deleting the app. If you have an active subscription, you must cancel it separately through your device settings to avoid further charges.

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Services ceases immediately. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Limitation of Liability, and Indemnification) shall continue to apply.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Sweden.

If you are a consumer in the European Union, you may also be entitled to use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Notify app users via an in-app notice (for significant changes)
• Post the revised Terms at plantgrail.com/terms

Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the changes, you should stop using the Services and cancel any active subscription.
